Specific Provisions for Dance AI: AI Dance Video Generator

1. Nature of the App and AI Dance Generation

Purpose: Dance AI uses neural network technology to transform uploaded videos and photos into AI-generated dance videos. The App is intended solely for personal entertainment, creative expression, and non-commercial or limited commercial use (as defined below).

How It Works: When you select a video or photo, the App uploads your content to secure cloud servers (AWS and Google Cloud Platform) where AI models generate a dance video based on your input. Your original video/photo is encrypted and temporarily stored for up to 48 hours to allow re-editing, then permanently deleted from our servers.

No Real Dance Instruction: The AI-generated dance videos are artistic transformations and do not constitute professional dance instruction, medical advice, or fitness guidance. You assume all risks associated with attempting to replicate any movements or poses shown in generated content.

2. Prohibited Content and Usage (Dance AI Specific)

You may not upload, generate, or share any content that:

• Exploitation of Children: Contains or depicts any person under 18 years of age in any sexual or inappropriate context. Any such activity will be reported to authorities (NCMEC) and your account will be permanently banned.
• Sexually Explicit Material: Contains nudity, sexual acts, pornography, or any sexually suggestive content intended for gratification.
• Violence or Harassment: Promotes violence, self-harm, bullying, harassment, hate speech, or discrimination based on race, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Unconsented Likeness: Uses the image or likeness of another person without their express written consent. You must own the rights to or have permission for every person visible in your uploaded content.
• Illegal Activities: Depicts or promotes illegal acts, drug use, weapons violence, or any activity that violates applicable laws.
• Impersonation: Impersonates any celebrity, public figure, or other individual without explicit authorization.

3. Ownership of AI-Generated Dance Videos

User Responsibility (Input Material): You retain all rights to the original videos and photos you upload. You represent and warrant that you own or have obtained all necessary permissions for any content you upload, including the likeness of any persons depicted.

Paid Subscribers (Dance AI Pro): If you have an active paid subscription, you own the AI-generated dance videos you create during your subscription period. You receive a worldwide, royalty-free license to use these generated videos for personal and limited commercial use (defined below). Attribution ("Created with Dance AI") is appreciated but not required for paid users.

Free Users: Free users may use generated dance videos for personal, non-commercial purposes only. Free users do not own the generated content. Attribution ("Created with Dance AI") is required when sharing publicly.

Commercial Use Defined: Commercial use includes any activity intended to generate revenue, including: posting on monetized social media accounts (YouTube with ads, TikTok Creator Fund, sponsored posts); using in advertisements or promotional materials; selling or licensing the generated video; or using in any business context. Commercial use requires a Dance AI Pro subscription.

No Reverse Engineering: You may not reverse-engineer, extract, copy, or attempt to replicate the underlying AI models, algorithms, or technology used by Dance AI for any purpose, including creating competing applications.

5. Subscription and Credit Limits (Dance AI Pro)

Auto-Renewing Subscriptions: Dance AI offers auto-renewing subscriptions (weekly, monthly, yearly). Payment will be charged to your Apple App Store or Google Play account upon confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Generation Limits: Each subscription plan includes a specified number of AI dance video generation credits per billing period. Unused credits will automatically roll over to the next period. Credits purchased as one‑time packs never expire.

Refunds: All payments are final and non-refundable, except as required by applicable law or as provided by Apple/Google refund policies. Please contact Apple Support or Google Play Support for refund requests.

6. Disclaimer of AI Accuracy

AI-generated dance videos are created algorithmically and may not always be perfectly accurate, anatomically realistic, or free from visual artifacts. Dance AI makes no warranty regarding the completeness, reliability, or artistic quality of AI-generated content. The output depends on the quality and nature of your input content. Results may vary significantly.

⚠️ AI Content Safety, User Reporting & Enforcement

The App includes AI-powered features that allow users to generate dance videos. You are solely responsible for the prompts, uploaded content, inputs, and your use of any AI-generated content.

Content Safety Rules

You agree not to use the Services to create, request, upload, generate, or share any content that violates these Terms, safety rules, applicable law, or platform policies. Prohibited content includes:

• Sexual content, nudity, sexually explicit or suggestive material, or content intended for sexual gratification;
• Non-consensual sexual material, sexualized content involving real persons, or content that violates privacy, dignity, or consent;
• Content involving the exploitation, abuse, sexualization, grooming, or harm of minors;
• Severe or graphic violence, threats, self-harm, abuse, harassment, or content encouraging harm;
• Hate speech, racial discrimination, abusive expressions, profanity, or content that attacks protected groups;
• Deceptive, misleading, fraudulent, impersonating, or unlawful content;
• Attempts to bypass, disable, manipulate, or evade our safety filters or moderation systems.

Moderation and Safety Systems

We use automated systems, safety classifiers, AI-based moderation, human review, and user reports to detect prohibited content. If detected, we may block uploads, prompts, or generation requests before they are processed or displayed.

In-App Reporting

The App includes in-app reporting features that allow users to report offensive, unsafe, or policy-violating AI-generated content. We review such reports to improve content filtering and enforcement.

Treatment of Violating Content

If any User Content or AI-Generated Content violates these Terms, we may restrict, disable, remove, or refuse to display such content. Violating content will no longer be available for normal use (view, download, share, edit, or export).

Enforcement Actions Against Users

We may take enforcement actions including: warning, blocking uploads, deleting violating content, restricting access to features, temporarily suspending generation tasks, placing account under manual review, suspending or terminating the account, or permanently banning repeat offenders.

Violation Records & Repeat Offenders

We record policy violation events to identify repeat offenders. For users who have violated safety rules but whose accounts remain active, their future requests may be subject to stricter safety checks, enhanced moderation, or manual review.

Purchased Entitlements & Account Restrictions

If an account is not suspended or terminated, users may continue to use valid purchased subscriptions or credits. However, if safety rules are violated, future generation requests may face stricter controls. If an account is terminated due to severe or repeated violations, all remaining credits, subscriptions, and associated content will be forfeited, except as required by law.

Severe Violations

Immediate enforcement without prior warning applies to: child safety risks, sexual exploitation of minors, non-consensual sexual material, severe violence, hate speech, or attempts to evade moderation. Such cases may lead to permanent ban and legal reporting.

Final Enforcement Authority

If we determine, in our sole discretion, that content or account activity violates these Terms or safety rules, we may remove content, restrict access, terminate accounts, and take any necessary action to protect users and platform integrity.

Eligibility

You must be at least 13 years of age to use Dance AI. If you are under 18 (or the age of legal majority in your jurisdiction), you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Users under 13 are strictly prohibited.

User Accounts

You may log in using third-party credentials (e.g., Apple ID, Google, Facebook). You are responsible for maintaining the security of your account and for all activities that occur under your account. Notify us immediately of any unauthorized use.

Privacy

Our Privacy Policy explains how we collect, use, and disclose your information, including your videos/photos. By using Dance AI, you consent to our Privacy Policy.

Prohibited Conduct (General)

You agree not to:

• Violate any applicable law or regulation
• Infringe the intellectual property or privacy rights of others
• Reverse engineer, decompile, or disassemble any part of the App
• Use bots, scrapers, or automated tools to access the App
• Interfere with or disrupt the App's servers or networks
• Impersonate any person or entity
• Upload viruses, malware, or other harmful code

Intellectual Property

All content owned by Dance AI, including the App's code, design, graphics, logos, AI models, and trademarks, is the exclusive property of Super Interactica Inc. You may not copy, modify, distribute, or create derivative works of any Dance AI intellectual property without our express written permission.

Termination

We may suspend or terminate your access to the App at any time, for any reason, including violation of these Terms. Upon termination, you must stop using the App and delete any locally stored content. We are not liable for any loss of data resulting from termination.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOU USE THE APP AT YOUR OWN RISK.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DANCE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS OR DATA. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU IN THE PRECEDING 12 MONTHS.

Indemnification

You agree to indemnify, defend, and hold harmless Dance AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, your User Content, or your violation of any third-party rights.

Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via in-app notice or email. Your continued use of the App after the effective date constitutes acceptance of the revised Terms. The applicable previous version will govern prior to acceptance.

Governing Law & Venue

These Terms are governed by the laws of the jurisdiction where Super Interactica Inc. is established (without regard to conflict of laws principles). Exclusive jurisdiction lies with the courts of that location, subject to exceptions for European Consumers where required by law.

Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and Dance AI. Our failure to enforce any right does not waive that right. You may not assign these Terms without our written consent. We may assign rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.
